Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Drunken Penguins platform at drunkenpenguins.com ("Service"), operated by Drunken Penguins ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Age Requirement

You must be at least 18 years of age to use this Service. Some cards mention drinking, so the Service is not intended for minors. By using the Service, you confirm that you are 18 or older. We reserve the right to terminate accounts or sessions of users we have reason to believe are under 18.

2. Accounts and Access

Creating an account is optional for players joining a room, but required for hosting a game with a paid card pack. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.

3. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation
Harass, abuse, threaten, or harm other users
Distribute malware, spam, or any malicious content
Attempt to gain unauthorised access to any system or data
Use the Service for any commercial purpose not expressly authorised by us
Impersonate any person or entity

We reserve the right to suspend or terminate access for any user who violates these terms or who we determine, at our sole discretion, is misusing the platform.

4. Purchases and Payments

The Service offers purchasable card packs and card games (such as Omi) as one-time, non-subscription purchases. All prices are shown in Sri Lankan Rupees (LKR) on each pack's page before you pay, and the price shown is the total you pay. Card payments are processed by PayHere (payhere.lk), a Central Bank of Sri Lanka approved payment service provider, and are also subject to PayHere's terms. We never receive or store your card details.

Delivery. Card packs and games are digital content. Nothing is shipped. A purchase unlocks on the account you bought it with as soon as PayHere confirms your payment, usually within a minute, and we email you a receipt. If a paid pack has not unlocked within an hour, contact us and we will sort it out.

A purchased card pack or game is licensed to the purchasing account only. You may use it in any room you host, but you may not transfer, resell, or share it with others outside of the game session.

5. Intellectual Property

All content on the Service (including card text, prompts, graphics, the Drunken Penguins name and mascot, and the underlying software) is owned by or licensed to Drunken Penguins and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any of this content without our prior written permission.

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Drunken Penguins shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, including any loss of data, revenue, or profits.

8. Responsible Drinking and Alcohol Disclaimer

Drunken Penguins is a party game. Some cards mention drinking, and an optional "drinking mode" suggests sips. Whether you drink, what you drink and how much is entirely your own choice and your own responsibility. Every game works the same without alcohol. We are not responsible for any outcome arising from the consumption of alcohol or any other substance by users of the Service. Nothing in the game is encouragement to drink, or to drink to excess.

Please drink responsibly. Know your limits. Never drink and drive. The Service is not affiliated with any alcohol brand.

9. Third-Party Services

The Service integrates with third-party providers including Clerk, Supabase, Resend, PayHere and our hosting provider. Your use of those services is subject to their respective terms and policies. We are not responsible for the actions or practices of these third parties.

10. Changes to These Terms

We may update these Terms from time to time. We will indicate changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them.
